Green Cask operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use and disclose your personal information when you visit, use, or make a purchase using the Services, or otherwise communicate with us. If there is a conflict between our Terms & Conditions and this Privacy Policy, this Privacy Policy applies to the collection, processing and disclosure of your personal information.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Please read this Privacy Policy carefully. By using or accessing any of the Services, you acknowledge that you have read it and understand how your information is collected, used and disclosed.

Our site is for adults only

Green Cask sells alcohol. The Services are intended for people aged 18 years or over, and it is against the law for us to sell or supply alcohol to anyone under 18.

We do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and believe a person under 18 has provided us with their personal information, please contact us using the details below and we will delete it.

Personal information we collect or process

When we use the term "personal information", we mean information that identifies, or can reasonably be linked to, you or another person. It does not include information collected anonymously or that has been de-identified so it cannot reasonably be linked to you.

Depending on how you interact with the Services, we may collect or process the following, including inferences drawn from it:

  • Contact details including your name, address, billing address, shipping address, phone number and email address.

  • Financial information including payment card details, financial account information, transaction details, form of payment and payment confirmation. Card details are processed by our payment providers; we do not store full card numbers.

  • Account information including your username, password, preferences and settings, where account features are available.

  • Transaction information including items you view, add to your cart, purchase, return, exchange or cancel, and your past transactions.

  • Communications with us including information you provide when you contact us, for example a customer support enquiry.

  • Device information including information about your device, browser or network connection, your IP address and other unique identifiers.

  • Usage information including how and when you interact with or navigate the Services.

Where we collect it from

  • Directly from you — when you place an order, create an account, use the Services, communicate with us, or otherwise provide your information.

  • Automatically through the Services — from your device when you visit our website, and through cookies and similar technologies.

  • From our service providers — where we engage them to enable certain technology, or where they collect or process information on our behalf.

  • From our partners or other third parties.

How we use your personal information

  • To provide and improve the Services. To perform our contract with you, process payments, fulfil and dispatch orders, arrange delivery, handle returns and exchanges, manage your account, remember your preferences, respond to enquiries and improve how the Services work.

  • Marketing and advertising. To send marketing and promotional communications by email, text message or post, and to show you online advertising, where you have not opted out. You can unsubscribe at any time using the link in any marketing email.

  • Security and fraud prevention. To authenticate accounts, provide a secure payment and shopping experience, and detect, investigate or act on possible fraudulent, unlawful or malicious activity. If you register an account, you are responsible for keeping your credentials secure and should not share them.

  • Communicating with you. To provide customer support, respond to your enquiries and maintain our business relationship with you.

  • Legal reasons. To comply with applicable law, meet our liquor licensing obligations, respond to valid legal process including requests from law enforcement or government agencies, and to enforce or investigate potential breaches of our terms or policies.

How we disclose personal information

We may disclose your personal information to third parties for legitimate purposes, subject to this Privacy Policy. This may include:

  • With Shopify, and with vendors and other third parties who perform services on our behalf — for example IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and delivery.

  • With business and marketing partners who provide marketing and advertising services. For example, we use Shopify to support personalised advertising with third-party services based on your online activity across different merchants and websites. These partners use your information in accordance with their own privacy notices. Depending on where you live, you may have a right to direct us not to share information about you for this purpose.

  • Where you direct or request us to, or otherwise consent — for example to deliver your order, or through your use of social media widgets or login integrations.

  • With our affiliates or otherwise within our corporate group.

  • In connection with a business transaction such as a merger or insolvency; to comply with legal obligations including subpoenas, search warrants and similar requests; to enforce our terms or policies; and to protect or defend the Services, our rights and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside.

We also use certain Shopify enhanced features that incorporate data obtained from your interactions with our store, along with other merchants and with Shopify. In those circumstances Shopify is responsible for the processing of your personal information, including responding to requests to exercise your rights over its use for those purposes. To learn more, see the Shopify Consumer Privacy Policy at shopify.com/legal/privacy/app-users. Depending on where you live, you may be able to exercise certain rights through the Shopify Privacy Portal at privacy.shopify.com.

Cookies

We use cookies and similar technologies to operate the website, remember your preferences and improve your browsing experience. You can disable cookies through your browser settings, although some parts of the site may not work correctly if you do. Further detail is set out in our Terms & Conditions.

Third party websites and links

The Services may link to websites or platforms operated by third parties. If you follow a link to a site we do not control, you should review its privacy and security policies and other terms. We are not responsible for the privacy or security of those sites, or for the accuracy, completeness or reliability of information found on them. Information you provide in public or semi-public venues, including third-party social platforms, may be viewable by others without limitation as to its use. Including a link does not by itself imply endorsement.

Security and retention of your information

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. However, no security measure is perfect or impenetrable, and information sent to us may not be secure while in transit. We recommend you do not use unsecured channels to send us sensitive or confidential information.

How long we keep your personal information depends on why we hold it:

  • Order and transaction records are kept for at least five years, to meet our taxation and liquor licensing obligations.

  • Marketing information is kept until you unsubscribe or ask us to remove it.

  • Account information is kept while your account is active.

  • Enquiries and correspondence are kept only as long as needed to deal with the matter and any related follow-up.

When personal information is no longer needed and we are not required to keep it, we destroy or de-identify it.

Your rights and choices

You have the rights set out below in relation to the personal information we hold about you. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

  • Access. You may request access to the personal information we hold about you.

  • Correction. You may request that we correct information that is inaccurate, out of date or incomplete.

  • Deletion. You may request that we delete personal information we hold about you, subject to any records we are required to keep.

  • Portability. You may request a copy of the personal information we hold about you, and ask us to transfer it to a third party, in certain circumstances and with certain exceptions.

  • Managing communication preferences. You can opt out of promotional emails at any time using the unsubscribe link in any marketing email. We may still send non-promotional messages about your account or orders.

We will respond to access and correction requests within 30 days. If we need longer, or if we decline a request, we will tell you why.

You may exercise these rights where indicated on the Services, or by contacting us using the details below. To learn more about how Shopify uses your personal information and any rights you may have in relation to data processed by Shopify, visit privacy.shopify.com.
