These Terms & Conditions govern your use of greencask.com.au and your purchase of goods and services from Green Cask. Please read them carefully. By using the Website or placing an order, you agree to be bound by these Terms.

Warning: Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under 18 years, and for a person under 18 years to purchase or receive alcohol.

You must be 18 or over. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18. By placing an order you confirm that you are at least 18 years of age and that the person receiving the delivery will also be 18 or over. Proof of age will be required on delivery. Green Cask holds a Victorian Remote Seller's Licence (No. 36313037) and a Pre-Retail Licence (No. 33781671).

1. About this Website

This Website is operated by Climate Control Technologies Pty Ltd (ABN 32 246 492 926) trading as Green Cask ("Green Cask", "we", "us", "our"), a licensed liquor retailer based in Victoria, Australia. By accessing or using greencask.com.au (the "Website") or placing an order, you agree to comply with these Terms & Conditions (the "Terms"). If you do not agree with any part of these Terms, you must not use the Website or place an order.

2. Definitions

  • "We", "us", "our" means Climate Control Technologies Pty Ltd trading as Green Cask.

  • "You", "your" means the user or customer of this Website.

  • "Goods" means any products or services supplied by Green Cask.

  • "Law" means all relevant state, territory and federal legislation, including the Liquor Control Reform Act 1998 (Vic), the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) and the Privacy Act 1988 (Cth).

  • "Intellectual Property" includes trademarks, copyrights, designs, recipes, and proprietary branding owned or licensed by Green Cask.

  • "Business Client" means a company, retailer or organisation purchasing Goods for resale, gifting or promotional use.

  • "Consumer Guarantees" means the guarantees that apply to the supply of goods and services under the Australian Consumer Law.

3. Interpretation

Unless the context requires otherwise:

  • words importing the singular include the plural and vice versa;

  • a reference to a person includes an individual, company, partnership, trust or other legal entity;

  • headings are for convenience only and do not affect interpretation;

  • a reference to legislation includes any amendments, re-enactments or replacements; and

  • "including" and similar words are not words of limitation.

4. Responsible service of alcohol

Green Cask is committed to the responsible sale and supply of alcohol. Under the Liquor Control Reform Act 1998 (Vic) it is against the law to:

  • sell or supply alcohol to a person under 18 years of age;

  • obtain, or attempt to obtain, alcohol by falsely representing your age; or

  • purchase or supply alcohol on behalf of a person under 18 years of age (secondary supply).

By placing an order you warrant that you are at least 18 years old and are not purchasing on behalf of a minor. We may, at our discretion, refuse or cancel any order, or refuse any delivery, where we reasonably believe these requirements are not met. Alcohol is only sold to, and delivered to, persons aged 18 and over.

Green Cask holds a Victorian Remote Seller's Licence (No. 36313037), which authorises the remote and online sale of liquor to consumers, and a Pre-Retail Licence (No. 33781671), which authorises the supply of liquor to licensees. We supply liquor only in accordance with the conditions of those licences and applicable law. We do not supply liquor to any alcohol-restricted, alcohol-protected or "dry" area, and where we deliver to the Northern Territory we comply with applicable minimum unit pricing rules.

5. Pricing & payment

  • All prices are in Australian dollars (AUD) and include GST unless otherwise stated.

  • Payment is required in full at the time of order through our approved payment methods. Your order is not accepted until payment has been received and confirmed.

  • We take reasonable care to ensure prices and product information are accurate. Where a pricing or description error is identified, we reserve the right to correct it and to cancel any affected order before dispatch, refunding any amount already paid.

  • Delivery charges (if any) are shown at checkout before you complete your order.

  • For Business Clients, any credit terms, where approved, will be subject to a separate written agreement.

6. Orders & acceptance

  • All orders are an offer by you to purchase Goods and are subject to availability and acceptance by us.

  • A contract is formed only when we confirm acceptance of your order or dispatch the Goods, whichever occurs first. An order confirmation email acknowledges receipt but does not by itself constitute acceptance.

  • We may decline or cancel an order at our discretion, including where Goods are unavailable, where we are unable to verify age or delivery details, or where we suspect fraud or a breach of these Terms. If we cancel an accepted order, we will refund any amount you have paid for the cancelled Goods.

  • Title to and risk in the Goods pass to you on delivery.

7. Delivery & age verification

  • We deliver alcohol within Australia to states and territories where we are lawfully permitted to do so. Delivery timeframes are set by our carrier and are estimates only. Current delivery information is set out in our Shipping & Delivery Policy.

  • An adult aged 18 or over must be present to receive the delivery. Our couriers are instructed to request valid photo identification proving the recipient is 18 or over, and may record proof-of-age details as required to comply with our licence obligations.

  • Alcohol will not be left unattended and no "safe drop" or unattended delivery is available for orders containing alcohol. Delivery may be refused where no person aged 18 or over is available, where valid ID is not produced, or where the recipient appears to be intoxicated.

  • Where a delivery cannot be completed for these reasons, the Goods will be returned to us. We will contact you to arrange redelivery or a refund, less delivery and handling costs incurred.

  • We are not able to deliver to parcel lockers or unattended collection points for orders containing alcohol.

8. Your consumer guarantee rights

Our Goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes those Consumer Guarantees.

Where there is a major failure with goods, you are entitled to a refund or a replacement, and the choice of remedy is yours. Where a failure does not amount to a major failure, you are entitled to have the problem rectified within a reasonable time and, if this is not done, to a replacement or refund for goods that are not of acceptable quality.

These rights are in addition to, and not limited by, the returns process described below.

9. Cancellations, returns & refunds

  • Because we sell alcohol and consumable products, and for health and safety reasons, we do not accept returns for change of mind. This does not affect your Consumer Guarantee rights in clause 8.

  • If your Goods arrive damaged, faulty, incorrectly supplied, or are otherwise not of acceptable quality, please contact us within a reasonable time with your order number and supporting photographs of the items affected. For breakages or damage in transit, please notify us within 14 days of delivery.

  • Where a valid claim is accepted, we will provide a replacement or refund as appropriate and as required by the Australian Consumer Law. Approved refunds are processed to your original payment method and are based on the price you paid, including any discount applied; promotional discounts are not re-applied to replacement Goods.

  • Once an order is confirmed it may not be cancelled unless agreed by Green Cask. Business Clients must notify us of any claim within 5 business days of delivery.

10. Intellectual property

All content on the Website — including text, images, logos, product recipes and branding — is owned or licensed by Green Cask and protected under Australian law. You may not copy, modify, distribute, or commercially exploit any of this material without our prior written consent.

11. Acceptable use of the Website

You must not:

  • interfere with the operation, integrity or security of the Website;

  • use the Website to engage in fraudulent, unlawful or misleading activity; or

  • reproduce or reuse Website content for commercial purposes without our consent.

12. Cookies, data & security

  • We use cookies and similar technologies to operate the Website and improve your browsing experience. You consent to our use of cookies unless you disable them through your browser settings; some features may not function correctly if cookies are disabled.

  • While we use reasonable measures to secure data transmission, no transmission over the internet can be guaranteed to be completely secure. You use the Website at your own risk.

  • You are responsible for taking your own precautions to ensure your access to the Website does not expose you to viruses, malware or other harmful interference. To the extent permitted by law, we do not accept liability for loss or damage to your equipment or data arising from your use of the Website.

13. Privacy

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By using the Website or placing an order, you consent to our collection, use and disclosure of your personal information as described in that policy.

14. Liability

Nothing in these Terms excludes, restricts or modifies any Consumer Guarantee or other right you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that:

  • to the extent permitted by law, we exclude all liability for indirect, special or consequential loss;

  • where our liability can lawfully be limited, it is limited (at our option) to the replacement of the Goods, the resupply of the services, or the payment of the cost of doing so; and

  • we are not responsible for delays or failures caused by third-party couriers, suppliers or events beyond our reasonable control.

15. Promotions

Promotional offers are subject to their specific terms, availability and time limits. We may modify or cancel a promotion at our discretion, subject to any rights you have under the Australian Consumer Law.

16. Wholesale terms (Business Clients)

Wholesale and on-premise orders are arranged directly with us by email and are not placed through the Website. For Business Clients, the following additional terms apply:

  • minimum order volumes and lead times may apply;

  • wholesale pricing is confidential and must not be disclosed to third parties;

  • resale of Goods must comply with all applicable liquor licensing laws, including holding any licence required in the relevant jurisdiction;

  • we may suspend or terminate wholesale supply where any term is breached; and

  • all Intellectual Property in co-branded products remains with Green Cask unless otherwise agreed in writing.

Certain Consumer Guarantees may not apply to goods or services acquired for the purpose of resupply or for use in a business; where they do apply, our liability may be limited as permitted by section 64A of the Australian Consumer Law.

17. Events beyond our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, industrial action, supply-chain disruption, courier failure, or failure of utilities or telecommunications. Where such an event continues for a prolonged period, either party may cancel the affected order and a full refund will be processed for any amount paid for undelivered Goods.

18. General

  • Severability. If any provision of these Terms is found to be invalid or unenforceable, it is to be read down to the minimum extent necessary, or severed, without affecting the remaining provisions.

  • Waiver. A failure or delay by us to exercise a right under these Terms is not a waiver of that right.

  • Assignment. You may not assign your rights under these Terms without our consent. We may assign or transfer our rights and obligations to a related entity or successor.

  • Entire agreement. These Terms, together with any order confirmation and our Privacy Policy, form the entire agreement between you and us in relation to your use of the Website and purchase of Goods.

19. Governing law & disputes

These Terms are governed by the laws of Victoria, Australia. If a dispute arises, we ask that you contact us first so we can try to resolve it quickly and fairly. If we cannot resolve the matter, a submission may be made to the courts of Victoria. Nothing in this clause prevents you from exercising rights or making a complaint to a relevant regulator, including Consumer Affairs Victoria or the Australian Competition and Consumer Commission.

20. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices or the law. The current version is always published on this page with its "last updated" date. Changes take effect when published, and your continued use of the Website after that date constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
